Terms & Conditions

These Terms & Conditions (“Terms”) govern your access to and use of the Hedgehog website at hedgehog.education (the “Site”) and the Hedgehog learning platform at app.hedgehog.education (the “Platform”), each operated by Hedgehog Education (“Hedgehog”, “we”, “us”, “our”).

By accessing or using the Site or the Platform, you agree to be bound by these Terms. If you do not agree, you must not use the Site or the Platform.

1. Who we are

Hedgehog Education is an education technology company established in Malta. You can contact us at mikea@hedgehog.education.

2. Eligibility and accounts

The Site is intended for general audiences. The Platform is intended for use by educational institutions, their teachers and their students, and is provided to those users under a separate agreement between Hedgehog and the institution.

Where you have been given access to the Platform by your school or university, you are responsible for keeping your sign-in credentials confidential and for all activity that occurs under your account.

3. Acceptable use

You agree not to:

  • Use the Site or the Platform for any unlawful purpose.
  • Attempt to gain unauthorised access to any part of the Site or Platform, including other users’ accounts.
  • Interfere with, disrupt or place an unreasonable load on the Site or Platform, including through scraping, scripted access or denial of service activity.
  • Use the AI tutor features in a manner intended to bypass the pedagogical guard-rails or to extract verbatim answers to assessment questions in violation of your school’s academic policies.
  • Upload or transmit content that is unlawful, defamatory, harmful, infringes intellectual property rights, or breaches the privacy or rights of others.

4. Intellectual property

The Site, the Platform, our software and our documentation are owned by Hedgehog or its licensors and are protected by intellectual property laws. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to use the Site and, where applicable, the Platform.

You retain ownership of the educational content you create on the Platform (such as exercises, prompts and answers). You grant Hedgehog a worldwide, royalty-free licence to host, copy, transmit and process your content solely for the purpose of providing and improving the services.

5. AI-generated content

Some Platform features use third-party large language models accessed through the Vercel AI Gateway to generate guidance, hints and feedback. AI-generated output may be inaccurate, incomplete or unsuitable for a given purpose. You are responsible for reviewing AI-generated output before relying on it.

6. Privacy

Our handling of personal data is described in our Privacy Policy. By using the Site or Platform, you confirm that you have read that policy.

7. Third-party services

The Site and Platform integrate with third-party services for hosting, authentication, analytics and email. We are not responsible for the availability, accuracy or content of those services.

8. Disclaimers

The Site and the Platform are provided “as is” and “as available” without warranties of any kind, whether express or implied, to the maximum extent permitted by law. Hedgehog does not warrant that the Site or Platform will be uninterrupted, error-free, secure or that any defects will be corrected.

9. Limitation of liability

To the maximum extent permitted by law, Hedgehog shall not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits, revenues, data or business opportunities, arising out of or in connection with your use of the Site or Platform. Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.

10. Indemnity

You agree to indemnify Hedgehog against any claim or demand, including reasonable legal fees, made by a third party arising from your breach of these Terms or your unlawful use of the Site or Platform.

11. Changes to the service and to these Terms

We may modify or discontinue parts of the Site or Platform at any time. We may update these Terms from time to time. Material changes will be notified by updating the “Effective date” above and, where appropriate, by direct notice. Your continued use after changes take effect constitutes acceptance of the revised Terms.

12. Governing law and disputes

These Terms are governed by the laws of Malta. The courts of Malta shall have exclusive jurisdiction over any dispute arising out of or in connection with these Terms, without prejudice to any mandatory consumer protection rights you may have under the law of your country of residence.
